1. Our Services
Lewcore provides web design, custom software development, and related digital consulting services. Specific project scope, deliverables, timelines, and pricing for any engagement are governed by the individual estimate and/or contract agreed to between you and Lewcore, which takes precedence over these general Terms where the two conflict.
2. Accounts
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.
3. Consultations and Bookings
Consultation bookings are subject to availability and may require confirmation. We reserve the right to reschedule or cancel a consultation with reasonable notice.
4. Payments
Fees for services are set out in your individual estimate or contract. Payments are processed securely through Stripe. Deposits, milestone payments, and final payments are due according to the schedule specified in your contract. Late or failed payments may result in a pause of project work until resolved.
5. Files and Intellectual Property
Files and content you upload, or connect via integrations such as Google Drive, remain your property. You grant Lewcore a limited license to access and use such files solely to deliver the contracted Services.
Unless otherwise specified in your individual contract, upon full payment for a project, ownership of the custom deliverables created specifically for you transfers to you. Lewcore retains ownership of its own pre-existing tools, frameworks, and general methodologies used to deliver the work.
6. Sales Representative / Referral Program
If you participate in our Sales Representative or referral program, your participation, commission rates, and payout terms are governed by your individual Sales Representative agreement. Lewcore reserves the right to adjust referral terms, deactivate a referral code, or terminate a Sales Representative relationship in accordance with that agreement.
7. Acceptable Use
You agree not to use the Services to violate any law, infringe on the rights of others, attempt to gain unauthorized access to our systems, or interfere with the proper functioning of the Services.
8. Account Termination
We may suspend or terminate your account if you violate these Terms. You may request deletion of your account at any time through your account settings.
9. Disclaimers and Limitation of Liability
The Services are provided "as is" without warranties of any kind, to the extent permitted by law. Lewcore's total liability arising from your use of the Services will not exceed the amount you paid to Lewcore in the twelve months preceding the claim, except where prohibited by law.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law principles. Any legal proceeding arising from these Terms will be brought in a court having proper jurisdiction in Baltimore County, Maryland.
